Fiscal Health of the States
The U.S. economy appears to be on the rebound, but states continue to feel the impact of the recession. To begin the conference, this session will offer an analysis of current economic indicators and predictions for what public officials should expect in the coming months. It will also address state budget trends, including ways that the states have dealt with shortfalls. Federal stimulus aid has been an important infusion of funds in the current fiscal year and as this source of relief begins to phase out, many states are working to close gaps for next year. Successfully balancing budgets is important to maintaining good credit ratings and, by extension, access to affordable capital.

eGovernment for Benefits Payments and SDU’s
In the current economic environment the criticality of expedited delivery of benefits to the intended recipient has become one of the key elements in supporting individuals and families.  Unemployment levels continue to rise.  Costs associated with the administration of the program must be carefully controlled to maximize efficiencies and economies of scale.  The movement from paper to electronic methods for disbursing benefits has leapt to an all-time high.  This interactive, informative session focuses on key programs including unemployment insurance, child support, child care, welfare and how State’s can help reduce administrative costs associated with paper programs, while increasing productivity, security and reducing fraud.

Assessing 529 Investments
This panel will explore the pros and cons of open architecture or multi-manager 529 programs, including a discussion on how plans balance the convenience of programs that are 100% invested in a particular fund family against the possibility that returns in some asset classes may not be optimized as a result of the restriction to a single fund family. The topic will be addressed by state administrators, investment professionals, and from a sales perspective as well. The panel may also address performance reporting issues such as how to establish industry benchmarks, it at all, and the possibility of achieving such standardization.

Leveraging the Professional Community

The 529 Regulatory Environment - Operational Guidance and Transparency
Speakers from the two entities that have regulatory oversight over Section 529 plans--the Municipal Securities Rulemaking Board and the U.S. Department of the Treasury's Office of Tax Policy--will share with us their views on the current regulatory environment with respect to Section 529 plans.  MSRB Senior Associate General Counsel Larry Sandor will speak on current issues including disclosure issues for non-account owners and EMMA's use by state issuers. Acting Tax Policy's role in the Treasury, and how Treasury interacts with Congress on proposed legislation affecting Section 529. Engaging Employers in 529 Outreach
This panel will look at what states have done to successfully engage employers in promoting and facilitating 529 Plans in the workplace. The session will (i) look at recently enacted legislation in the State of Illinois to provide employers with a state tax credit for matching contributions to their employees' 529 Plans; (ii) review the importance of employer participation and employer "buy in" in order to increase the presence of 529 Plans at the national level, not just in the workplace; (iii) describe the issues faced and successfully overcome by both programs and employers when offering 529 Plans through the workplace; and (iv) discuss legislative and policy changes needed to make employers champions of 529 Plans. The panel will also look at the emerging role of 529 Plans in workforce retraining.

QSCBs & CREBs: An Overview of Federal Tax Credit Programs and their Potential for Municipal Issuers
Qualified School Construction Bonds (QSCBs) and Clean Renewable Energy Bonds (CREBs) are among the many types of municipal bonds that have been created or revitalized through the American Recovery and Reinvestment Act. These programs are intended to enhance the development and expansion of primary education and renewable energy infrastructure through the provision of tax credits. These programs, like other ARRA programs, have significant potential benefits for municipal bond issuers. Issuers must, however, plan for, structure, and administer these programs properly in order to garner the full measure of their benefits. Furthermore, these programs continue to evolve and the attendant rules continue to be modified to improve their efficiency and marketability. Understanding the complexities and nuances of these programs will be important for municipal governments in 2010 and beyond.

Swaps and Counterparties: The Changing Face of Counterparties and Implications to Derivative Products
The collapse and contraction of financial institutions over the last several years has had various implications in the areas of derivative products and swaps. Some issuers have seen their counterparties on these agreements become insolvent with little to no financial recourse, while others have watched as credit deterioration and downgrades on both sides of these agreements (issuer and counterparty) have required the posting of collateral or other financial remedies. Additionally, the current low interest rate environment has made the potential termination of many outstanding swap agreements extremely costly for issuers, while at the same time problems in the variable rate debt markets have caused issuers to seek termination of the very same swap agreements. The market movements and transformations within this space require an extraordinary amount of added diligence and general knowledge on the part of issuers to properly monitor their positions and steer their way through the hazards and financial implications wrought in the past year.

Escrow Structures and GICs: Innovative Solutions to Improve New Money & Refunding Economics
The structuring of escrows using Open Market Securities (versus SLGS), call date optimization, and competitive bidding of defeasance portfolios enhance the economic benefits of refundings. Build America Bonds: Structure, Pricing, and Mechanics of BAB Issuance
Last year may come to be known as the year of the BAB. The success of this program can be measured by the large par amount of BABs issued in 2009 and the interest savings realized by BABs issuers. Furthermore, as the BAB market developed and matured throughout 2009, the investor base for these bonds has become increasingly comfortable with more traditional tax‐exempt structures and sales methods. In order to take full advantage of BABs, issuers must be aware of the various intricacies related to BAB structures, pricing and mechanics, and where, when, and how to employ the different features that are now widely accepted by the market.

We Don’t Have the Resources to Reinvent the Wheel’--Determining Priority Needs in Your State and Resources Available to Meet Them
There are good partnership resources available to help State Treasuries understand priority financial literacy and education needs--and help address them. For example, the FINRA Foundation’s National Financial Capability Survey, developed in consultation with the US Department of the Treasury and the President’s Advisory Council on Financial Literacy and issued in December 2009, measures the financial capabilities of American adults and reveals in detail how Americans save, borrow and plan for their financial futures. This session discusses the new Partner Tomorrowsmoney.org portal that has been completely redesigned, updated in English and Spanish and enhanced with additional information, websites, and capabilities. Learn how to use this resource to leverage and extend your other programs. This session begins the discussion of ways to meet financial literacy needs of particular communities or target audiences and will also include an open discussion on next steps for this initiative and financial literacy education, outreach and marketing needs that can be met through the network of monthly calls and e-newsletters.

A Case Study in Extreme Owner Outreach
Learn how Texas Comptroller of Public Accounts Susan Combs used innovative methods to completely reorganize the unclaimed property program in less than one year with dramatic results. Initiatives included dedicating two grass-roots outreach staff members, conducting unclaimed property town hall meetings, researching and returning over $2 million to cities and counties, and switching to regional publications that produced 50% more claims worth 57% more dollars than the year before.

The Nuts and Bolts of Online Auctions
States hold on to items for years that are found forgotten in safe deposit boxes at financial institutions. However, if the owner is not found, the state cannot continue to warehouse the items and turns to online auction sites like eBay to sell the items and hold the money for the owners instead. State experts will present the entire online auction process and its advantage over traditional auctions.

What is Cost Basis Reporting?

The Automation of Claims Processing
Learn how one state went from paying claims in 90 days to two weeks. Methods will be presented for paperless processing and conducting searches before evidence requests, while remaining transparent to the owner.  The process will be examined in detail that automatically evaluates a claim to determine if it can be approved and paid without requiring manual evaluation while still meeting pre-determined matching thresholds.

Electronic Payment Systems: Issues for State Unclaimed Property Programs
As the disbursement of funds shifts increasingly from checks to other payment mediums, both states and holders face questions concerning the interpretation and application of the unclaimed property law to such transactions. This session will cover why understanding this is crucial for the states and all other aspects of the issues involved, including the CARD Act of 2009, and regulatory role of the Federal Reserve. Discussions will cover special issues arising with respect to unclaimed wages, rebates, and gift cards.
